On November 16, 2018, the Department of Education released its proposed Title IX regulations, which are intended to create rules for how institutions address and respond to reports of sexual harassment on their campuses. While the proposed regulations must go through the note and comment process before they are final, these proposed regulations have understandably left many institutions anxious about compliance in the ever-changing Title IX legal landscape.

The proposed regulations are broad ranging, touching on many different aspects of your institution’s policies and procedures, including imposing new requirements for the complaint resolution process. Most impactful is a new provision mandating that every institution hold live hearings with an opportunity for cross-examination. In addition, under the proposed regulations, institutions must provide the parties with access to information collected during the investigation that is directly related to the allegations and an opportunity to respond to that evidence and to the investigation report prior to a determination of responsibility.
